The ordinary power of attorney can be used to see to it that donor and his family are well taken care of in the event of any circumstances that may affect the ability of the donor to manage his affairs. Some of these circumstances could be in case of an accident, if the donor is away on holiday or any other circumstance. As a donor, this document appoints an attorney to act on your behalf in personal or financial matters. You can give the attorney the power to do several things for you such as use your bank account, pay your bills, run your business, sell your property or shares, and pay your taxes among many others.
Before deciding on whom to appoint as your attorney, you should think very carefully. You should appoint someone you trust like your partner, friend or adult child. The person you appoint should also be a person who can act with your best interests at heart. This person should also be in a position to take up the role whenever necessary responsibly. In medical conditions that might make you lose your legal capacity, the person should be able to make decisions that are based on what matters to you. However, this document can not be used in the event that the donor becomes mentally unstable. Instead the document’s authority ends automatically if the donor is declared mentally incapable. In such a situation, the Lasting Power of Attorney is used. In order for the Lasting Power of Attorney to be useful, it must have been created before the mental incapacity arose.
According to the Powers of Attorney Act of 1971, the attorney has an almost unlimited power of the donor’s affairs and thus a lot of caution is recommended. The power of the attorney you have appointed ceases if they becomes bankrupt, if they resign or if they die. The General Power of Attorney can be changed or canceled at any stage. You can appoint more than one attorney and you can also choose whether they make decisions on your behalf jointly or jointly and severally. By jointly it means that they must all agree to any decisions made and that every document required will be signed by all of them. In the latter it means that either of the attorneys can make a decision and sign the necessary documents together or without the others. However, you can limit the powers that your attorney has. You can do so by placing conditions on how you want them to execute their responsibilities. For instance you can limit their power such that they can only pay bills or deal with the sale of your shares but they can not deal with your property
